4. San Diego tent permit and fire code rules

These rules come from San Diego Fire-Rescue (SDFD) Guideline E-1.4: Tent and Membrane Structures (Rev. October 2023), which applies in the City of San Diego.

  • Permit threshold: tents with an area in excess of 400 square feet require an SDFD permit. Tents open on all sides are exempt if each is 700 square feet or less and has at least 12 feet of clearance to structures and other tents.
  • Lead time: permit applications are due at least two weeks (10 business days) before the event.
  • Setbacks: tents may not be within 20 feet of lot lines, buildings, other tents, parked vehicles or internal combustion engines, and support ropes and guy wires count as part of the tent.
  • Fire access: fire apparatus access must be at least 20 feet wide with 13 feet 6 inches of vertical clearance.
  • Extinguishers: one Class 2-A-10B:C extinguisher in every tent, plus one for each additional 2,000 square feet; a Class K extinguisher for cooking with oils or fats.
  • Exits: every point must be 100 feet or less from an exit. A tent holding 10–199 people needs 2 exits at least 72 inches wide; 200–499 people need 3 exits; 500–999 need 4.
  • Floor plans and decor: a floor plan is required at an occupant load of 50 or more, and decorative materials that are not fire resistant are prohibited in tents with 50 or more people.
  • Open flame and fireworks: no open flame within 20 feet of a tent open to the public without SDFD approval; no fireworks within 100 feet; cooking that produces sparks or grease vapors not within 20 feet; cooking and heating equipment not within 10 feet of exits; combustible vegetation removed within 30 feet.
  • Lighting: exit paths lit to at least 1 foot-candle at floor level; above 300 occupants, emergency power lasting at least 90 minutes.
  • Generators: at least 20 feet from tents.
  • Duration: a temporary tent may stand no more than 180 days in a 12-month period.

San Diego County Fire rules (unincorporated areas)

From the San Diego County Fire / CAL FIRE Temporary Tents Checklist (references the 2022 California Fire Code):

  • Wind: when wind speeds exceed 25 mph, tent fabric must be removed.
  • Layout: at least 3 feet between the fabric and all contents; exits at least 72 inches wide; aisles at least 44 inches wide; illuminated exit signs when the occupant load is greater than 49.
  • Generators: at least 20 feet from tents and fenced or enclosed away from the public.

Tent permit rules by city

Fire permit thresholds for the cities Tents and Things serves, from each city or fire agency. What this means for our tents: a 20×20 (400 sq ft) and every canopy (400 sq ft or less) stay at or under the 400 sq ft threshold used by most cities; a 20×30 (600 sq ft) usually needs a permit if it has sidewalls; a 20×40 (800 sq ft) needs one everywhere a threshold is published.

California state rule

Under California Code of Regulations Title 19 §332, every tent made for sale, sold, rented or used in California must be made of nonflammable material or State Fire Marshal–approved flame-resistant fabric.

5. City of San Diego park rules

From the City of San Diego Facility and Park Use Permit Application:

  • Shade structures larger than 20 x 20 feet require a fire permit and Park and Recreation District Manager approval. Canopies up to 20 x 20 are standard park permit items.
  • Applications must be submitted at least 10 days before the event (SDMC §63.0103); Mission Bay Park event applications are due 120 days ahead.
  • Events with 300 or more people need one portable toilet, plus one for each additional 150 people, and one lidded dumpster with a recycling bin for each full 300 people.

6. San Diego weather and wind for outdoor events

From NOAA/National Weather Service Climate of San Diego (Technical Memorandum WR-270), based on historical normals (1971–2000):

  • Average annual rainfall is 10.77 inches; 85% falls November through March and only 2% June through August.
  • Santa Ana winds occur most often October through February, with December the most frequent month. The normal afternoon sea breeze averages about 10 mph from the west; the peak recorded gust was 64 mph (January 1988).
  • Average daily highs peak around 78°F in late August and early September. The daily temperature range is about 15 degrees at the coast and 30 degrees or more a few miles inland.

What this means for tent rentals: summer events in San Diego mainly need shade, not rain cover. Between October and February, Santa Ana winds can push gusts past the 25 mph point where County Fire requires tent fabric to come down, which is why Tents and Things may reschedule for unsafe weather. Inland events (El Cajon, Santee, Escondido, Poway) see larger evening temperature drops, where sidewalls help.

7. Quick answers

Do I need a permit for a 20×20 tent in San Diego?
In the City of San Diego, no fire permit is required by size alone, because a 20×20 tent is exactly 400 square feet and the SDFD permit applies to tents in excess of 400 square feet. Park, HOA and venue rules may still apply.
Do I need a permit for a 20×30 or 20×40 tent in San Diego?
A 20×40 (800 sq ft) requires an SDFD permit. A 20×30 (600 sq ft) requires one unless it is open on all sides with at least 12 feet of clearance to structures and other tents. Apply at least two weeks ahead.
Which San Diego County cities require a permit for a 20×30 tent?
A 20×30 tent is 600 sq ft, over the 400 sq ft threshold used by the City of San Diego, Chula Vista, El Cajon, Encinitas, Escondido, Oceanside and Poway. Several of these exempt open-sided tents up to 700 sq ft with 12 ft clearance, and Carlsbad only requires a permit for a 20×30 if it has sidewalls.
How much space does a tent need in a backyard?
Tents and Things plans for about 25 x 25 feet for a 20×20, 30 x 40 feet for a 20×30 and 30 x 45 feet for a 20×40. Permitted tents in the City of San Diego must also stay 20 feet from lot lines, buildings and vehicles, with guy ropes counted.
How many guests fit under a tent?
About 33 seated at round tables under a 20×20, 50 under a 20×30 and 66 under a 20×40. Standing capacity is about 66, 100 and 133.
Can I put a tent in a San Diego city park?
Canopies up to 20 x 20 are standard park permit items. Larger shade structures need a fire permit and District Manager approval. Park applications are due at least 10 days ahead, or 120 days for Mission Bay Park events.
What happens if it is windy on my event day?
San Diego County Fire requires tent fabric to be removed when winds exceed 25 mph. Tents and Things may cancel for unsafe weather and will either refund in full or let you choose another date.
Where can a generator go near a tent?
At least 20 feet from the tent, and fenced or enclosed away from the public under San Diego County Fire rules.
Can we use sparklers or a grill near a rental tent?
SDFD Guideline E-1.4 prohibits open flame within 20 feet of a tent open to the public without approval, fireworks within 100 feet, and spark- or grease-producing cooking within 20 feet.
Can I use fabric draping or hay bales in a tent?
In tents holding 50 or more people, SDFD prohibits decorative materials that are not fire resistant.
What does a Tents and Things rental include?
Up to 24 hours of use, delivery and pickup, and tent setup and takedown. Table and chair setup is a paid add-on, and delivery fees depend on the address.
